TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, using, or engaging with any services provided by Sell A Home ("Company," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Sell A Home.

If you do not agree to these Terms, you must not access or use our services. Your continued use of our services following any modifications to these Terms constitutes your acceptance of such modifications.

These Terms apply to all users of our services, including without limitation users who are browsers, clients, and any other individuals who access or use our services.

2. SERVICE DESCRIPTION

Sell A Home provides guided home selling support services designed to offer clarity and confidence throughout the home selling process. Our services are educational and supportive in nature and include, but are not limited to:

Seller Education & Guidance: Educational resources, information, and guidance regarding the home selling process, market conditions, pricing considerations, and general best practices for home sellers.

Listing Preparation Support: Assistance and recommendations for preparing your property for listing, including guidance on staging, repairs, improvements, photography preparation, and presentation strategies.

Closing Process Navigation: Support and guidance through the closing process, including explanation of documentation, timeline management, and general process overview.

Our services are intended to provide information, education, and support to home sellers. Sell A Home does not act as a licensed real estate agent or broker unless explicitly stated otherwise. We do not represent you in real estate transactions, negotiate on your behalf, or execute real estate transactions. Any real estate transactions must be conducted through appropriately licensed professionals in accordance with applicable law.

The Company reserves the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of our services without notice or liability.

3. USER OBLIGATIONS

As a user of our services, you agree to:

Provide accurate, current, and complete information during registration and throughout your engagement with our services, and maintain and promptly update such information to keep it accurate, current, and complete.

Use our services only for lawful purposes and in accordance with these Terms and all applicable local, state, national, and international laws and regulations.

Not use our services in any manner that could disable, overburden, damage, or impair our systems or interfere with any other party's use of our services.

Not attempt to gain unauthorized access to any portion of our services, other accounts, computer systems, or networks connected to our services.

Not use our services to transmit any false, misleading, fraudulent, or illegal communications.

Take full responsibility for decisions you make regarding the sale of your property. While we provide guidance and education, all final decisions rest with you.

Engage qualified, licensed professionals (including real estate agents, attorneys, inspectors, and other specialists) as needed and as required by law for your real estate transaction.

Maintain confidentiality of any account credentials or access information provided to you.

Acknowledge that you are responsible for obtaining any necessary third-party consents or permissions related to your property and its sale.

Respond to our communications in a timely manner and maintain reasonable communication throughout the service engagement.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Appointments for consultations, guidance sessions, or other services may be scheduled through our designated scheduling system or by contacting us directly at Lane.Preston@sellahome.info.

You are responsible for arriving on time for scheduled appointments, whether in-person, by phone, or via video conference. If you arrive more than 15 minutes late to a scheduled appointment, we reserve the right to cancel or reschedule the appointment.

Cancellation Policy: If you need to cancel or reschedule an appointment, you must provide at least 24 hours advance notice. Cancellations or rescheduling requests made with less than 24 hours notice may be subject to a cancellation fee or may result in forfeiture of that session, depending on your service package.

We reserve the right to cancel or reschedule appointments due to emergencies, illness, or unforeseen circumstances. In such cases, we will make reasonable efforts to notify you as soon as possible and reschedule at a mutually convenient time.

Repeated failure to appear for scheduled appointments or repeated late cancellations may result in termination of services without refund.

No-Show Policy: If you fail to appear for a scheduled appointment without prior notice, it will be considered a "no-show" and may result in forfeiture of that session and/or assessment of a no-show fee.

5. PAYMENT TERMS

Fees for services will be clearly communicated to you prior to engagement. All fees must be paid according to the payment schedule agreed upon at the time of service engagement.

Payment methods accepted include credit cards, debit cards, electronic bank transfers, and other payment methods as we may designate from time to time.

Unless otherwise specified in your service agreement, payments are due in full prior to the commencement of services or according to the payment schedule provided to you.

All fees are quoted in United States Dollars (USD) unless otherwise specified.

Refund Policy: Due to the personalized and time-intensive nature of our services, all sales are final once services have commenced. Refund requests will be evaluated on a case-by-case basis prior to the commencement of services. Once guidance sessions have begun or materials have been provided, no refunds will be issued except at our sole discretion.

Late Payment: Any payments not received by the due date may be subject to late fees of 1.5% per month (or the maximum amount permitted by law, whichever is less) on the outstanding balance. We reserve the right to suspend services until payment is received in full.

Disputed Charges: If you wish to dispute any charge, you must notify us in writing at Lane.Preston@sellahome.info within 30 days of the date of the charge. Failure to notify us within this timeframe constitutes your acceptance of the charge.

Price Changes: We reserve the right to change our fees at any time. Any price changes will apply to services purchased after the effective date of the change and will not affect services already purchased.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Sell A Home, its owners, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, revenue, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of, or inability to access or use, our services.

Any conduct or content of any third party related to our services.

Any content obtained from our services.

Unauthorized access, use, or alteration of your transmissions or content.

Any decisions you make or actions you take based on information or guidance provided through our services.

The results or outcomes of your home sale transaction.

In no event shall the aggregate liability of Sell A Home, whether in contract, warranty, tort (including negligence), product liability, strict liability, or other theory, arising out of or relating to these Terms or the use of or inability to use our services exceed the amount paid by you to Sell A Home for services during the twelve months preceding the claim.

You acknowledge and agree that the real estate market involves inherent uncertainties and risks. Sell A Home provides guidance and education but cannot and does not guarantee any specific results, outcomes, sale prices, timeframes, or other metrics related to your home sale.

You expressly assume all risk for your decisions and actions related to selling your property. You agree to independently verify all information and seek appropriate professional advice before making any decisions.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

7. WARRANTY DISCLAIMERS

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Sell A Home does not warrant that:

Our services will meet your specific requirements or expectations.

Our services will be uninterrupted, timely, secure, or error-free.

The information, guidance, or recommendations provided through our services will be accurate, reliable, complete, or current.

Any defects in our services will be corrected.

Our services are free of viruses or other harmful components.

The guidance and information provided through our services is educational in nature and based on general principles, market knowledge, and experience. However, every real estate transaction is unique, and we cannot guarantee that any particular strategy, approach, or recommendation will be suitable for your specific situation or will produce any particular result.

You acknowledge that real estate markets are subject to fluctuations and external factors beyond anyone's control, and that past performance or historical trends are not indicative of future results.

We do not provide legal, tax, or financial advice. Any information provided that touches on legal, tax, or financial matters is general in nature and should not be considered professional advice. You are responsible for consulting with appropriately licensed professionals (attorneys, accountants, financial advisors) regarding your specific situation.

We are not responsible for errors or omissions in any content or for any actions taken in reliance on such content.

The disclaimers set forth in this section apply to the fullest extent permitted by applicable law.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any disputes arising out of or related to these Terms or our services shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which Sell A Home operates, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts of competent jurisdiction in the location where Sell A Home operates, and you consent to the personal jurisdiction of such courts.

Prior to initiating any legal action, you agree to first contact us at Lane.Preston@sellahome.info to attempt to resolve any dispute informally. We commit to working with you in good faith to reach a mutually acceptable resolution.

In the event that informal resolution is not achieved within 30 days, either party may pursue formal dispute resolution.

You agree to waive any right to a jury trial in any proceeding arising out of or related to these Terms or our services.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Sell A Home, its owners, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from:

Your use of or access to our services.

Your violation of any term of these Terms.

Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

Any claim that your use of our services caused damage to a third party.

Any decisions you make or actions you take related to selling your property.

This defense and indemnification obligation will survive termination of these Terms and your use of our services.

10. INTELLECTUAL PROPERTY

All content, materials, information, and intellectual property provided through our services, including but not limited to text, graphics, logos, images, videos, software, guides, templates, and methodologies (collectively, "Content"), are owned by or licensed to Sell A Home and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Content solely for your personal, non-commercial use in connection with your home sale. This license does not include any right to:

Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our Content, except as incidentally necessary for your personal use.

Use our Content for any commercial purpose or for any public display.

Remove or alter any copyright, trademark, or other proprietary notices from our Content.

Transfer, sell, license, or otherwise provide our Content to any third party.

Systematic retrieval of Content to create or compile, directly or indirectly, a collection, compilation, database, or directory.

Unauthorized use of our Content may violate copyright, trademark, and other laws and may result in termination of your access to our services and potential legal action.

11. CONFIDENTIALITY AND PRIVACY

We respect your privacy and are committed to protecting any personal or confidential information you share with us. Information about how we collect, use, and protect your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that in the course of providing services, you may share sensitive information about your property, financial situation, and personal circumstances. We will maintain reasonable confidentiality of such information and will not disclose it to third parties except:
